Delhi HC Refuses Special Delhi Assembly Session To Table CAG Reports, Says 'Inordinate Delay' By AAP Govt

The Delhi High Court on Friday stated that there was an 'inordinate' delay in tabling several Comptroller and Auditor General reports on governance at state assembly by the Delhi government and refused to direct a special session for doing so ꦺahea๊d of the upcoming assembly polls there.

The senior lawyers for the speaker and the governm𒊎ent opposed the court passing such a direction and said there was no urgency to table the reports at a stage when the assembly elections were to be held soon.

What Did Court Say?

Justice Sachin Datta said there was an "inord💮inate delay" on part of the Delhi government in the m♋atter.

The court also underlined the🍒 tabling of the audit reports was mandatory under the Constitution.

"The court is not inclined to accept the prayer of the petiti✤oner to summon a special sitting of the assembly," it held.

Who Were Petitioners?

Opposition leader Vijender Gupta and BJP MLAs Mohan Singh Bisht, Om Prakash Sharma, Ajay Kumar Mahawar, Abhay Verma, ♔Anil Kumar B♑ajpai and Jitendra Mahajan filed the petition last year and sought a direction to the speaker to call a sitting of the assembly for tabling the CAG reports.

The petitioners filed t🦄he ple🌳a through advocates Neeraj and Satya Ranjan Swain.

The assembly secretariat had earlier stated that no useful purpose would be served in laying CAG reports before the assembly when its tenure was ending in February and no judicial order could b✅e passed to the speaker in matters of interꦰnal functioning of the legislative assembly.

During a hearing held on January 13, the court said the CAG reports should have been promptly placed before the assembly for discussi▨on and the state government "dragging its feet" on the issue raised "doubts on its bonafides".

The court had reserved the order on January 16 after he꧟aring all the parties.
